This page explains what personal data I process in connection with the website janutesil.cz, why, how long I keep it and what rights you have.
This is an English translation provided for convenience. In the event of any discrepancy, the Czech version prevails.
Who processes your data
Jan Utěšil, real estate agent, self-employed, operating under the Jaroš & Partners | Real Estate brand.
- Company ID (IČO): 04234391
- E-mail: jutesil@jaros-partners.cz
- Phone: +420 723 345 212
I am the controller of your personal data. I have not appointed a data protection officer, as I do not meet the statutory conditions requiring one — you can contact me directly about anything.
What data I process
Data from the contact form
When you fill in the form on this website, I process the details you entered yourself:
- name — so I know who I am replying to;
- e-mail address — so I can reply;
- phone number — optional, if you would rather I called;
- the text of your message — including any details about a property that you choose to include.
Technical data attached to the submission
Along with your message, the IP address the form was sent from, your browser identification, the page address you submitted from and the time of submission are stored automatically. This data protects the form against abuse and automated spam. I do not use it to identify you or to build a profile.
Data when simply browsing
If you only browse the site and submit nothing, no data about you is stored. The site uses no analytics or advertising tools, does not track your behaviour and stores no cookies in your browser. The fonts are hosted on this site itself, so loading a page does not connect you to any third party.
The hosting provider processes technical access logs at network level in order to keep the site available and secure.
Why I process it
I process data from the form so that I can answer your enquiry and, where relevant, agree terms of engagement with you. The legal basis is steps taken at your request prior to entering into a contract under Article 6(1)(b) GDPR — you approach me, and a reply is the natural consequence.
For the technical data protecting the form against abuse, the legal basis is legitimate interests under Article 6(1)(f) GDPR, namely the secure operation of the website.
I do not use your data to send marketing messages or newsletters. Were I ever to want to, I would ask for your consent first.
Who receives the data
I do not pass your data to anyone for their own purposes and I do not sell it. I use the following processors:
I have a data processing agreement in place with the form provider. Because its servers are in the United States, data is transferred outside the European Union. The transfer is safeguarded by Standard Contractual Clauses approved by the European Commission.
If you would rather your data did not leave the EU, write to me directly by e-mail or call — you do not have to use the form at all.
How long I keep it
- An enquiry that does not lead to an engagement: no longer than 2 years from our last contact. I then delete the message.
- An enquiry that does lead to an engagement: for the duration of the engagement and afterwards for as long as the law requires — in particular accounting, tax and anti-money-laundering legislation.
You can ask for earlier deletion at any time.
Your rights
In relation to your personal data you have the following rights under the GDPR:
- right of access — you may ask what data I hold about you;
- right to rectification — if the data is inaccurate;
- right to erasure — where there is no longer a reason to keep it;
- right to restriction of processing;
- right to data portability — I will provide the data in a machine-readable format;
- right to object to processing based on legitimate interests;
- right to lodge a complaint with the supervisory authority.
Just write to jutesil@jaros-partners.cz. I will respond within one month at the latest. The supervisory authority is the Office for Personal Data Protection (Úřad pro ochranu osobních údajů), Pplk. Sochora 27, 170 00 Prague 7, uoou.cz.
Security
The site runs exclusively over an encrypted HTTPS connection. Access to submitted enquiries is password-protected and I am the only person with access. The form provider has undertaken to report any security breach within 72 hours.
Changes
If the way data is processed changes, I will update this page and amend the date of last revision.
